Read this first: answers.yahoo.com/question/index?qid=20071208081504AAQ8QqnWhat rights do you think a thief has if he goes in and hurts himself. I think that the thief knows and understands the risks. If he doesn't or if he wants to risk it, good for him. Honestly, I've seen a case where a thief tried to break a window, got cut on the glass, and sued... Your thoughts?

I say nothing should happen to the owner of the home. If a thief breaks in, he has committed illegal trespassing, breaking and entering, and intends to commit felony robbery. He knowingly is doing these crimes, if he gets himself killed committing the crimes...well that's just too dang bad now isn't it? I should be able to do whatever I see fit to protect my home, family, and property from a stranger who intends to harm one or more of the three.
Hell, I've heard of cases where someone broke in, got bit by the family dog, sued the family, and had the dog put down. stuff like that shouldn't happen....in this country or anywhere. The fact that the criminals in this country get a slap on the wrist or less in most states for doing felony crimes is stupid.

in my state the theif forfeits any rights to sueing the moment he commits his crime and if he is caught by the owner and the owner feels threatened the owner can shoot to kill if necessary without legal repercussions.... i tend to agree with this...

yes, you can be charged for it, even though it is protecting yourself, and possible your family, yo can still be charged, my friend's brother hit some guy that broke into his girlfriends car, the guy still got away, but my friend's brother still got away...i find it a bit stupid, but "it's the was she goes"...

That should depend on the situation. If someone is stealing your TV, then it shouldn't be ok to kill them. Yes they're wrong, yes, they should go to prison, but killing them seems extremely drastic.
They made a mistake, and should have to face consequences, but they do not deserve to be murdered. As far as I am concerned, no one does. If there is a risk to you and your family, then you should be allowed to use rational violence, but killing should be something to avoid. Call the police instead of shooting, perhaps.

If they have a gun and they break into my house they are getting shot and I shouldn't get charged since they could have been planning to use it. If they don't have a gun me holding the gun at their face should keep them occupied until the police arrive.

I think that the legal system is so messed up that no matter what you do ,it's wrong! The criminal seems to have more rights than the victim. The honest people have lost their rights!

Tighter gun control would solve the aforementioned scenario as well, and a host of other problems with it.

Yeah, I agree with tippy. Why are we being nice to criminals while stealing thousands of $$$s from innocent folk...
